Waiver
Release and Waiver of Liability:
I realize that participation in these Events involves risks, including physical demands, adverse weather and vehicles on or about the race course or at the various Event venues, among other risks. I nevertheless wish to volunteer to participate in the Event activity as a volunteer and I assume the risks involved, including physical injury or death. I am in good health and physically able to perform the activities I have chosen. If necessary, I authorize the Events to provide medical attention for me at my expense. In consideration of the foregoing, I hereby waive and release in advance all rights and claims for damages I may have against the Big Sur Marathon, Big Sur Marathon Foundation (BSMF), its Directors, officers, volunteers, employees, USAT&F, AIMS all sponsors, charities, community groups, contractors, suppliers, the state of California and anyone otherwise connected with the Events, even those rights and/or claims resulting from their negligence. Further, I hereby grant full permission for all of the foregoing to use my likeness in any accounting of these Events. I have read and understand this entire Release and Waiver of Liability Agreement. I am making this Release and Waiver of Liability Agreement in exchange for the privilege of participating in the Events as a Volunteer and for partaking of the facilities and benefits provided by these Events. I must be at least 16 years old unless accompanied by an adult. Registration for minors must be completed by a Parent or Legal Guardian. If your age on race day is less than 18 year old, please fill in the Parent/Guardian Contact Information below. Providing such information and continuing this process indicates that this registration was completed by the person listed below.
Special Covid Requirements:
I understand there is a risk of exposure to COVID-19 in all of the Big Sur Marathon Foundation (BSMF) events and surrounding areas. Such events include races, the race course, the start and finish areas, marathon flats, promotional activities, open houses, [arties, food and beverage events, sales events, seminars, workshops, volunteer activities, travel to and from races and other events, pre-and post-race activities, and all other related activities and surrounding areas (collectively the "Events"). By registering as a volunteer I understand that to volunteer for any of the BSMF Events, I expressly agree to comply with any and all rules and safety guidelines put in place by local, state and federal governmental entities and the Event organizers, including those rules and guidelines listed on the Big Sur Marathon website bigsurmarathon.org and/or sent to me by email from the Event organizers as updated. I voluntarily assume all risks related to exposure to COVID-19 at all of the Events.
I understand that to volunteer in any of the BSMF Events, I may be required to show proof that I am fully vaccinated (including with any boosters as may be recommended by CDC), show proof of a negative COVID test within a certain time period before the Event, and/or take all other actions required by BSMF or local, state and federal governmental entities related to COVID safety requirements and protocol.
I agree and promise that I will not volunteer for any of the BSMF Events if I have been exposed to a person suspected or known to have COVID-19 within 5 days before my volunteer task begins, or if I feel ill before any of the events.
Use of Information:
BSIM does not sell, rent, or provide your non-public personal information to anyone other than as stated above. Unless required by subpoena or other court order, BSIM will not disclose or share your personally identifiable information with any individual, organization, company, or non-affiliated third party. BSIM may, however, at its sole discretion, share statistical data with race sponsors or media agencies. Statistical data do not include personally identifiable information about any individual and is used for quantitative purpose only.
